As of 2026, roughly 39 states plus Washington, D.C. have licensure or registration laws for behavior analysts, while about 10 states still have no formal licensing law — including California, Florida, Idaho, Colorado, and West Virginia. In those states there is no statute that forces a technician to hold the RBT.

The practical reality: even where no state law requires it, the RBT is effectively mandatory to get hired and paid. Since 2019, Medicaid has required BACB credentialing for ABA reimbursement, and most private insurers and employers follow suit. In other words, whether or not your state licenses behavior analysts, you will almost certainly need the RBT — and therefore the exam — to work as a behavior technician and to have your services billed.
